Thank goodness, it has been almost five years since child care providers have experienced a crisis in obtaining liability insurance. In a 1988 Child Care Information Exchange article entitled "Do You Have Swiss Cheese Liability?" we identified a variety of precautions, particularly insurance exclusions or situations not covered by your insurer, to take when purchasing liability insurance. Unfortunately, there is still a long and growing list of exclusions but, unlike our recent past, today's market reflects good availability of liability insurance. However, its adequacy and affordability remain a tenuous commodity.

So the old adage, "let the buyer beware," still remains true since not all insurance is equal, particularly once you get past the first page of your policy and begin to discover what's under the cover. In spite of availability, it is wise to look beyond the bottom line of cost per child.

For instance, today there are a number of new exclusions that did not exist in 1988, and plaintiffs' attorneys have been successful in using several new strategies such as unlawful trade practices in recovering damages to injured children (see "Teacher Aides and Other Dangerous Instruments," in the June 1990 Exchange for more detail).
